Terms and Conditions for the Supply of Products and Services

These terms and conditions apply to your order for MAC Renewables Products and/or Services. Please read them carefully. We would like to draw your attention to sections listed as being “Important Sections” in the table below.

Which Parts of these Conditions Apply to My Order?

These Conditions are broken down into several parts, and your Order will be governed by one or more of the following sections, depending on the type of Product and Service(s) you have ordered (as set out in your Order):

About Us and How You Can Contact Us

We are MAC Renewables Ltd, a subsidiary of MAC & Facility Management Ltd, registered as a limited company in England and Wales with company number 06858221. Our trading names are MAC Renewables and MAC Solar. You can contact us by the following means:

PART A – General Terms

1. Definitions and Interpretation The following definitions and rules of interpretation apply in these Conditions:
Term Definition
Conditions The terms and conditions set out in this document as amended from time to time in accordance with section 10.10 of Part A.
Contract The contract between MAC Renewables and the Customer for the sale and purchase of Products and/or Services, comprising these Conditions and the Order.
Consumer An individual purchasing Products and/or Services from us for purposes outside their trade, business, craft, or profession.
Customer The person or entity purchasing the Products and/or Services from MAC Renewables (also referred to as “you” or “your”).
Installation Services Services provided for the installation of Products at the Premises, as detailed in the Order and relevant scoping documents.
MAC Renewables MAC Renewables Ltd (Company Number: 06858221), trading as “MAC Solar” and “MAC Renewables”.
Order Your order for Products or Services submitted to us via any method specified by us, including online, phone, or email.
Premises The location at which the Products will be installed or Services will be performed, as set out in the Order.
Product Warranties The warranties described in section 4.1 of Part B.
Products Solar panels, inverters, batteries, and other renewable energy equipment supplied, installed, maintained, or repaired by us.
Repair Services Services provided to repair Products, solar installations, or associated systems.
Services The services detailed in the Order, including Installation, Maintenance, Repair, or Hire Services.
Trade Customer Any Customer purchasing Products and/or Services for trade, business, or commercial use.

2. The Order Process When you submit your Order, this constitutes an offer to purchase Products and/or Services from us. You are responsible for ensuring that the information provided in your Order is accurate. The Order is accepted when we issue an Order Confirmation, at which point the Contract is formed. The Order Confirmation will contain the details of your Order, including any specifications and relevant documentation. If you notice any discrepancies in the Order Confirmation, please contact us immediately. You acknowledge that Repair Services may be requested on an “ad-hoc” basis, and in such cases, a formal Order Confirmation may not always be provided.
3. Price and Payment The price of the Products and/or Services will be as set out in the Order and confirmed in the Order Confirmation. Prices may exclude VAT and additional costs, such as delivery fees, unless otherwise stated. For Consumers, we will provide an “all-inclusive” price during the Order process, including VAT and any applicable delivery fees. If the cost of the Products or Services increases due to factors beyond our control, we will notify you before delivery. Payments are typically required in advance, unless we have agreed to provide credit or deferred payment terms. Failure to pay by the due date may result in interest charges and suspension of the Contract.
4. Ending the Contract We may end the Contract immediately if you fail to make payments, breach any terms of the Contract, or experience insolvency. For Consumers, additional cancellation rights may apply under consumer protection laws. If you are a Consumer, you may also have the right to cancel within 14 days of placing your Order, subject to certain conditions. If you cancel after installation has begun, you may be liable for costs incurred.
5. Liability We will not be liable for any loss of profits, business, or indirect damages unless caused by our negligence. Our total liability for any claims will be limited to 125% of the value of the Products and/or Services provided under the Contract. Nothing in these Conditions limits our liability for death, personal injury, or fraud.

PART B – Supply of Products

1. Product Specification While we provide information about the specifications of our solar Products, it is your responsibility to ensure the suitability of the Products for your requirements. Images and descriptions are for illustrative purposes only.
2. Title and Risk Title to the Products passes to you upon full payment. If you are a Trade Customer, we retain title to the Products until full payment is made. During this time, you must store the Products separately and ensure they are adequately insured.
3. Delivery Delivery will occur at the location specified in your Order Confirmation. While we strive to meet the Proposed Delivery Date, this is an estimate, and we are not responsible for delays outside our control. If you are unavailable to accept delivery, we may charge for additional delivery attempts.
4. Product Warranties We warrant that our Products will:
  • Conform to their description
  • Be free from material defects
  • Be of satisfactory quality
For Trade Customers, if you believe the Products do not conform to these warranties, you must notify us immediately, and we will arrange an inspection or return of the Products at our expense. Consumers have additional statutory rights under the Consumer Rights Act 2015.

PART C – Installation Services

1. Installation Services We will provide the Installation Services as outlined in your Order, with reasonable skill and care. For solar installations, we will comply with MCS standards and ensure that all installations meet regulatory requirements.
2. Your Responsibilities You must ensure that we have free and safe access to your Premises, provide any necessary permissions or consents, and notify us of any hazards, such as asbestos, before installation begins.
3. Additional Works If additional works are required beyond the scope of the Installation Services, we will provide you with a quote. You may cancel your Order if you do not agree to the additional charges.

PART D – Maintenance and Repair Services

1. Maintenance Services Maintenance Services will be provided according to the schedule agreed upon in your Order. If any equipment requires repairs, we will provide a separate quotation for Repair Services.
2. Reactive Call Outs You may request ad-hoc call outs for urgent maintenance. A standard call-out fee will apply, and any repairs required will be quoted separately.
3. Maintenance Period The Contract for Maintenance Services will continue for the period agreed upon in the Order and will automatically renew unless terminated by either party.

PART E – Hire Services

1. Equipment Hire You may hire solar equipment from us for use at your Premises. The Hire Equipment remains our property at all times, and you are responsible for ensuring its safe and proper use during the Hire Period.
2. Hire Period and Rental Payments The Hire Period will continue for the duration specified in your Order. Rental payments are typically due monthly in advance.
3. Delivery and Inspection Hire Equipment will be delivered to the location specified in your Order. You are responsible for inspecting the equipment upon delivery and reporting any issues immediately.
4. Ending the Contract You may terminate the hire services by providing the required notice, and we will arrange for the collection of the equipment. If you fail to return the equipment in good condition, you may be charged for repairs or replacements.
These Terms and Conditions are designed to protect both you and MAC Renewables in the supply, installation, and maintenance of renewable energy systems. Please contact us if you have any questions or require further clarification.  

PART F – Renewable Energy-Specific Terms

1. Compliance with Regulations We comply with all relevant UK and EU legislation concerning the installation and maintenance of renewable energy systems, including the Microgeneration Certification Scheme (MCS). By working with MAC Renewables, you are assured that our installations meet the highest industry standards and are fully compliant with MCS guidelines and other regulatory frameworks. 2. Installation of Solar Products We ensure that all solar panels, inverters, battery storage systems, and other related equipment are installed in accordance with manufacturer guidelines and applicable industry regulations, including:
  • MCS standards: Ensuring high-quality, safe, and reliable installation of solar photovoltaic (PV) systems.
  • Building Regulations: Ensuring all necessary permissions and approvals are obtained and adhered to.
  • Electrical Standards: Compliance with UK wiring regulations (BS 7671) to ensure safe electrical installations.
3. Performance and Maintenance of Solar Products We commit to delivering systems that meet or exceed the manufacturer’s performance specifications. However, solar power system performance may vary based on factors such as weather conditions and shading at your Premises. We recommend regular servicing to maintain peak efficiency, which can be included in your Maintenance Contract.

PART G – Dispute Resolution

1. Dispute Resolution Process If a dispute arises concerning these Terms and Conditions or the Contract, both parties agree to attempt to resolve it informally in the first instance by direct discussion. 2. Mediation If the dispute cannot be resolved through informal negotiations, either party may suggest mediation through an independent third party agreed upon by both parties. This process is voluntary and non-binding unless both parties agree to a settlement. 3. Legal Proceedings If mediation fails or is not pursued, both parties retain the right to pursue legal proceedings. The Contract is governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

PART H – Warranty for Renewable Energy Products

1. Product-Specific Warranties Our solar panels and related equipment come with specific warranties provided by the manufacturers. These warranties typically cover defects in materials and workmanship for a specified period (usually between 10 and 25 years, depending on the product).
  • Solar Panels: Manufacturers generally provide long-term performance warranties ensuring that the panels will perform at a specified efficiency rate over a set period.
  • Inverters: Typically come with a 5-10 year warranty, depending on the model and manufacturer.
  • Battery Storage Systems: Warranties may vary, usually covering a minimum number of charge/discharge cycles.
2. Repair and Replacement If any part of your solar system covered under warranty becomes defective, we will work with the manufacturer to repair or replace the affected component at no additional cost to you (unless the fault is due to misuse or external factors beyond our control). 3. Exclusions Warranties do not cover damage caused by external factors, such as:
  • Improper maintenance, storage, or handling.
  • Environmental conditions, such as flooding or storms, unless otherwise stated by the manufacturer.
  • Modification or alteration of the system by non-qualified personnel.

PART I – Customer Responsibilities for Renewable Systems

1. Regular Maintenance It is your responsibility to ensure that your renewable energy system is regularly maintained according to the manufacturer’s guidelines to prevent issues and maintain performance. You may choose to enter into a maintenance agreement with MAC Renewables to cover regular servicing. 2. Access to the Premises You must ensure that we have adequate and safe access to your Premises when providing installation, maintenance, or repair services. This includes clear access to roof areas, electrical systems, and any other relevant areas for service provision. 3. Permissions and Consents You are responsible for ensuring that any necessary planning permissions or local authority approvals are obtained before we begin installation. MAC Renewables is not responsible for delays or costs arising from the absence of required permissions unless explicitly agreed upon.

PART J – Energy Performance and Savings

1. Energy Savings The energy and financial savings from using renewable energy systems depend on various factors, including your usage patterns, geographic location, and system size. While we provide estimates based on industry-standard calculations, actual savings may vary. MAC Renewables does not guarantee specific savings or performance levels. 2. Feed-In Tariffs and Incentives You may be eligible for government or utility incentives, such as feed-in tariffs or renewable energy rebates. It is your responsibility to apply for these programs. We can provide guidance, but MAC Renewables does not guarantee eligibility for any specific incentives or schemes.

PART K – Changes to Terms and Conditions

We may update these Terms and Conditions periodically to reflect changes in legislation, industry standards, or our business practices. If we make any significant changes, we will notify you by email or via our website. The updated Terms and Conditions will apply to all future orders and ongoing Contracts unless otherwise agreed.
By placing an order with MAC Renewables, you agree to the terms and conditions set out in this document. Please ensure you have read and understood them before proceeding with your purchase or service agreement.
